We have a person at work who their doctor said they can have "no work duty" because of their foot. They had an achillies operation back in 1/20/07. Now they say they are not allowed to drive and we see them walking or driving can we take a pic and will that be evidence for dismissal?

Ok so if I am the report to manager and I have someone hang and take a picture of a person doing something not right it will be OK?

I found out that at their last place of employment they were fired for being on leave to long, for an elbow injury

Well I am just trying to get a person to fill their shoes so I don't have to do the extra work. I've had 2 major surgeries and had no problem working............. It is my business It's my job and that person I am responsible for.

It's possible, but unless you are the HR rep or not at risk of losing your own position, it may be best to not put yourself in that position. See if you can anonymously report it or refer it up to a manager and have them investigate it.

It sounds like you are a Nosy Parker, and a buttinsky. It also sounds as if you have something personal against this individual, trying to dig into personal business. Unless you are an insurance investigator, or a company doctor, keep out of it. If you are wrong you open yourself up to lawsuit. You also risk being charged with stalking. Seeing someone drive a car is no proof the person can work a job. Being able to walk a block is no proof the person can work a job. I was handicapped after a car accident for 10 months. I walked, and the last four months I drove. I did not go to work until my surgeon certified I could.

We all do a lot of things the Dr. says we shouldn't , You have no clue how much pain that person is in . And moving around a bit is a whole lot different then working a 8 hour day. I think I'd find something better to do with my life then nark on another person.

You can't, but your work comp attorney's office probably has a private investigator who can - the pic needs to be dated and you need to have someone testify when it was taken. This is absolutely a way to disallow the claim, dismiss the employee, and also get the person indicted for fraud.

Speak to your HR director and inform them of what you had witnessed, he will contact the disability insurance and they will get an investigator on it. Lets face it you and I pay for these people that rip off the system. He can be made responsible to pay back what he has in effect stolen from the system.

You could video tape the guy driving. Pictures are static and would show him just sitting in a car. Moving pictures showing him driving, he would not be able to deny.
