New York is a one party state, that means that all it takes is the consent of one party on the line. however some courts will not admit an interview with a witness to an event if they were not informed they were being recorded. Apparently the judge may use his discretion.

Yes, you can. It doesn't make any difference if you were aware or not. Provided that at least ONE party to the conversation is aware it is being recorded, it should be admissible in court.

yes you can ,but he had to inform you that you were being recorded if he did not inform you then most likely the judge will not listen to it . good luck.
