I'm curious and I would like to know. I helped someone with the downpayment for a car, I asked for a loan to helped this person. I was promised I was going to be payed back (it was an exgirlfriend), I was never paid. I don't like the idea of going to court because I always thought people I trust was trustable. I don't know what my ex is thinking but whatever she thinks, is not paying anything. I wonder what the bible says, we should forgive and let it go, or go to a judge?

not to worry!
if you want to forgive and forget the bible will support you in that decision:
"....forgive us our debts, as we forgive our debtors"

however,

if you prefer to really stick it to her and go for the gold the bible also has your back:
"an eye for an eye"

"give unto Caesar what is Caesar's"

thats the great thing about the bible, you can get whatever you want from it!

Here comes the judge, here comes the judge. Forgiveness isn't about money matters, and she violated your trust. You must still have feelings for her if you took out a loan to "help". You weren't donating to the needy and the poor, you gave her a loan. It's not a Bible thing, it's a legal matter.

If you don't have proof that it was a loan and you were to be paid back don't bother with small claims court. I think the bible says kill them though! Old testament!

If you have a contract that says she owes you money, take her to court and get what you're owed.
If you don't have a repayment contract or a promissory note (or at least a witness to her saying "I'll pay you back"), then it would be very hard for you to get the money back in court, so then I think you should let God handle it.

She is stealing. The bible is anti-stealing. Take her to court. There is nothing in the bible that says not to seek legal remedies for injuries (just don't bear false witness).

If you can afford the loss, forgive and forget. Jesus said that we are to give to the person who asks for a loan.
