If you are pregnant, you cannot get a DNA test until after the baby is born (prenatal testing is doable, but risky and not recommended).
If you know it isn't his, then either approach the real father or file a paternity action against the real father. This will "freeze" your ex out of the picture.
FYI: he's an idiot for pretending to demand a DNA test that he knows will come back negative.
Why are you upset? If you know it's not his, then what's the problem?
DNA tests are now mouth swabs, and they do NOT require everyone to be in the same room.

The question comes down to why is the ex asking for a DNA test? Have you mentioned anything to him that would cause him to think that you will demand child support? Heck, even if you don't demand it now, should you ask for public assistance you will have to name the father. (Then the power of the state bears down full force to extract reimbursement from the father for the state's costs to you in public assistance).
As to the lawyers, the other folks in this forum are right, they will charge by the hour. Whether or not they drive the bills up is a matter of their own ethics. Your ex may have an attorney who is charging a flat fee to get a DNA test court order also. So, the more you drag things out in court, the more the judge may hold you in contempt.
The best thing to do is to let the DNA test happen once the child is born. Then you will have your own ammunition to keep the ex away if the child is not his.
Of course, the other side could happen, He is the childs father. Then what? Child Support orders, Shared Custody with the ex. ....

If it's not his kid, and you're not asking for child support, then he has no right to a paternity test.
You don't have to do anything until a judge orders you to, but I don't see why it's even necessary if you both know it's not his baby. Maybe more info? ... why is he taking you to court in the first place?

Okay, so you got pregnant by someone else while you were supposedly with your ex, and you're trying to cost him as much money, time, and frustration as you can because he got you upset while you were pregnant? With someone else's baby??
Dang, lady! Are you trying to get child support out of him for a baby you both know isn't his? Why else would he be asking for a paternity test?

If you're pregnant and upset why would you want to drag it out? Yes it will cost more but doing it out of spite will just end up being bad for you in the end. Be an adult about it and get it over with.
