I have went back and forth to court trying to get residential custody back for my son he doesn't want to live with his father he wants to remain with me although he is only 6 doesnt he have rights too or isnt there a NY state law that can help me out in his deffense

The court will sometimes take what the child wants in to account. But the primary thing they look at is what would be best for the child.

As you probably know, sometimes what the child wants is not always in his best interest. While the courts usually favours the mother, when it is evident that the father can provide the best home life, they will grant custody to him.

Your child doesn't have any rights that he alone can exercise. Right now the court is ensuring that his rights aren't compromised.

It's time to hire a lawyer for your son. That would be the best thing to do. If money is a issue get family and friends to give a $50.00 donation to the cause. It's a very good cause and it is Okay to ask for help.
