He got blamed for the bullet hole in the ceiling which the suicide attempter put there in the struggle. The guy also said my brother came in with a gun and tried to kill him. My brother took the guns away and held them for a day. The guy then came and moved the guns to another man's home. My brother is being charged with removal of evidence from the crime scene. He might even be charged with assault with a deadly weapon. Point is, he's being blamed for something he didn't do. Is that justice?

There was nothing fishy about the situation. The reason my brother took the guns is because he didn't want it to happen again. The man was drunk. My brother didn't call the police because he has illegal substances, so who would believe him anyways...

Think about it. You've had a jail-time history, the other guy didn't. You've had a drug history, and at the current moment, you're not thinking completely clear, and you've just been in a bad, almost deadly situation. The suicide attempter is now very pissed off with you and drunk too... what do you do? where do you go? Cops won't help... at least none of the cops around here will..... can anything be done? He JUST finished a series of AA meetings only to get thrown away for a while. Where are the Anarchists when you need them!?

I know that all of the facts were not presented here. The burning question in my mind is why your brother chose to cover up the situation instead of calling the police right away. This intentional delay and his tampering with the evidence appears to show intent.

Sorry to say but nothing can be done as your brother, though possibly well intentioned screwed up.

OK he may have taken the guns and given them back. Great. But the fact that he was there, didn't call the police anoymously, there was a struggle, he has a record, says the guy was drunk (your brother is in AA), ETC. ETC. Then ther is the holding weapons...... it lokks like someone owed someone something.

The judge is going to believe the other guy...... period. Your brother really has no defense. He didn't call the police because he was holding? He could have flushed them. If he was so high that he was afraid to call the police? They will question that because maybe he was not thinking properly so his testimony is in doubt. This is because of his record.

Then they will really doubt the circumstances. Usually people who are commiting suicide do so alone but often call someone because they don't really want to do it. If one was just showing up or hanging with that person how would one be close enough to "wrestle" the weapon away when it takes 1/8 of an inch to pull the trigger. So you are sitting there trying to disuade someone from killing themselves. You hang or just leave so that is fishy.

Maybe your brother tried to do the right thing but odds are there is more to the story and the judge will feel the same. Usually if one has been busted before they stay away from people who have weapons about.

The real bottom line is that something happened and your brother is still doing drugs.

Attempted suicide is a crime. Police should have been called immediately as they have professionals who deal with these situations. Good intentions are not appropriate - your brother could have been injured or killed wrestling over the gun, it could have gone off injuring someone else, and the person is unbalanced and needs professional psychiatric care. The gun is evidence, and the place it happened is a crime scene. Your brother could also be charged with theft, assault, and illegal possession of a firearm, among others. I'd recommend his getting a good attorney, and he'll probably learn a hard lesson. I wish him luck.

No but what your brother should a done when he took gun away was call police and been very earnest to all arriving officers police know when someone is telling truth or not by the way suspect treats them .He shouldnt have removed anything from other mans house even though your brother was trying to help he STILL must help within the bounds of law

No that is not justice the legal system never works. Sorry about your bro. How did he get arrested by stopping someone from killing themselves? He just took the guns away so the other guy won't kill himself.
