My friends and i were parked on the side of a road smoking some pot. Constables got a call that our car was suspicious. They went and told us to get out of the car one by one. Then they Continued to search the car finding just a bit of marijuana left.

Could they have searched the car without our permission. It was in Harris County, Houston Texas.

If you were in Texas (US), then yes....

A search of a car rarely requires a warrant. And a casual search can be done for any grounds based on reasonable suspicion.

Parked by the side of the road for a while -- even if the didn't smell of marijuana (which it probably did) -- is generally sufficient grounds to have you step out and conduct a visual search of the passenger compartment.

If there was any odor of marijuana, that justifies a thorough search of the passenger area.

Yes, they can search your car with probable cause.
Permission or no permission you were on the side of the road which is their teritory smoking an illegal substance.
They can search all they want!

If they saw something that gave them the suspicion there were illegal items in the car they can search without a search warrant.

Yeah, they have probable cause.

Even if you said no, it would have raised a red flag to the officer. Best bet was to let'em search it.

you answered your own question.........they.got a call that our car was suspicious....so they could.
you could refuse to have them search.........but then that is another issue........you would be charged with intefering (sp) or some such charge, and they would have searched it anyway, and you'd be arrested...... opposed to the summons that was issued.........unless you had a mega amount
