You say he's a cheap and stingy, therefore want to commit fraud by using his credit card without authorization. I don't know who's paying for the RN schooling, the rent, the food, the medical bills and the furniture, the repairs and everything else necessary to run a household but it seems disrespectful to denigrate someone on the Internet without giving that person a chance to defend himself. It is entirely possible that he's not really making as much money as you think he is. It is also possible that his job is not as secure as you think it is. He may be genuinely worried but doesn't want to worry you.

If your signature is on the card, you will have no trouble using it. If it has his signature, that could present a problem being refused by the merchant.
Phone or online orders will not know it.
The worst thing that can happen is your husband can cancel the card. Being spouses, you both are responsible for all debts.
HOWEVER, he could have you blocked from use with the card issuer, and he would be the only one authorized to use it. If that is the case, I doubt he would allow you to have the card in the first place.
You could apply for a card of your own based on your combined credit standing. This may create problems but he would still be as responsible as you are for the debt.

The stores/gas stations rarely if ever check - they don't care actually. I've bought gas on my friends card numerous times with no problem.
The problem will come from your husband when he finds out - maybe. Remind him that when you married he promised to take care of you in health, etc. and what is his is yours and visa versa. The issue of spending will open a can of worms, maybe, and then you can discuss your relationship in depth! That should be fun.

If the account is in his name only and you don't have authorization, it's fraud; and no one should accept the card from you for usage. But as his wife, there isn't much he can do to sue you; your biggest problem will be if he gets mad enough to divorce you.

Yes, you will. If he is in title to it and your not you can go to jail.You will go to jail because they think your lying about being married to him. Also as you said it was only made for him, not YOU.
