recently i had finacial problems which left me with lots of bank charges that i was unable to pay off. the situation has now left me very over drawn, last thursday after a visit to the halifax they have froze my other bank account which is in credit. they are refusing to allow me to withdrawn any monies which are my child benefits and child tax credits and csa payments money that is given to support my 7 children. i currently have no money to even feed my children or pay my essential bills. when i relaid this situation to halifax head office they still refuse to release my money even though i have had legal advise that it is illegal for the bank to retain money that is given by the government to provide for my children. Do you have any further information about legal issues on this matter? Thanks.

The bank can continue to collect the funds going into the account until your account is in the positive. The best thing you can do is pay the charges and move on. Whether this means borrowing from family or friends thats up to you but until the account is positive again you won't have access to the money going into the account. Its not the banks fault you had financial problems and they have the right to try to collect their money from you. Eventually the account will be shut down, you will be sent to chexsystems (collections), and you will not be able to have an account anywhere. Sorry about the situation. This is why I got out of bank management. I hated not being able to help people because it is what it is.

what your telling me sounds like a travesty. The Father should be monitored and have to check in with a government official every 2 weeks, Put on probation to help support the child. Where are the parents in this situation are they poor, or is the mother 32? Got to be honest with you someone should establish a half-way house for unwed mothers with no visitors except parents, and the parents should go through counseling before talking to a 16 year old daughter with a child. Can't blame her, her mind might not be fully developed just sometimes the mind is immature and the body is mature. Someone ought to help her for the wrongful life she is living now. All these years all those teachers teaching her your body is your own do what you want to with it it belongs to you. Sad Story! Herd it thousands of times from teachers in school be independent make up you own mind. Without consulting adults teachers and people are thoughtless.

Can you have your benefits sent to you directly? A bank can put a hold on your account if your significantly overdrawn, or if they have a court order to to so (like if someone sued you for money you owe, they can put a hold on your account so that as soon as any money goes in the suing party can withdrawal it) I don't know if their are special laws about not holding the money if its government benefits. I would say try to have your money redirected directly to you and use a check cashing service, pay everything in cash until you get on your feet and can reopen your accounts. As far as whats already in the bank I don't know, maybe you can call a lawyer (sometimes they will be willing to offer advice over the phone for free). Good luck to you!
