Three strikes laws, or more commonly referred to as Habitual Offender Law, are statutes enacted by state governments in the United States which require the state courts to hand down a mandatory and extended period of incarceration to persons who have been convicted of a serious criminal offense on three or more separate occasions.
On March 5, 2003, the U.S. Supreme Court held by a 5-4 majority that such sentences do not violate the Eighth Amendment of the U.S. Constitution, which prohibits "cruel and unusual punishment."

Every State in the USA has the "three strike policy" for repeat offending felons and violent crime(s) offenders, it was a law that was Federally mandated. The problem is inconsistency, some States utilizes the three strike law, whilst others don't because of other State legal interpretations.

In Michigan a third felony or "attempted" felony is punishable by twice the sentencing guidelines. Watch those "attempted" resisting arrest charges all to often used as STACKED CHARGES to induce a voluntary plea bargain agreement. I was railroaded with a disturbing the peace charge followed by two "attempted resisting arrest charges"....ludicrous!!! The United States is not a free country many laws are vague and severe and the monster is growing ferociously!
