im currently going through a letting agent. she accepted dss behind the landlords back. i cant give her months rent up front again and need to wait till get my housing benefit sorted.

landlord now knows about dss as im a week late with rent and is threatening to cancel my agents contract.

if he cancels their contract, what are my rights to staying in the house as a tenant? ive got 2 small kids

I don't know where you live or what the legalities are. This is one problem. Then your going through an agent, bad news.

Go see the landlord, the agent seems to have a bad rep with him/her. Throw yourself at his feet and tell him you need the apartment, the hell with the agent. She screwed you so the should void any contract you have with her, case solved there.
Ask the land lord if he'll take you. Your probably paying an agents fee to start with.
