You really need to hire a good family law attorney in your State to get good advice. If you don't know of any, you can contact your local Bar Association and they can provide you a list of attorneys in your area that specialize in that area.

To even begin to give even a halfway decent answer you would need to indicate at least the following in your question:

Is the mother that "adopted" the son the birth mother? If so, it it would have nothing to do with adoption, it would have to do with custody.

In any custody battle, there are too many variables for anyone on YA to give you a good answer...a law firm where I used to work would sometimes have an entire file cabinet drawer or more full of one custody battle, especially if it went on for years.

What State to you reside in? Laws vary greatly depending on where you live.

Were your husband and the mother ever married?

Was paternity of your husband ever established in Court?

Was the case of custody ever in the Court system or is it just the mother never pursued child support?

Did your husband ever sign papers terminating his rights to the child that were filed with the Court? Several states will not allow termination even if the mother wants it also unless the father is a danger to the child or another man wants to adopt the child as his own.

What verifiable evidence exists anywhere that will show that the mother is abusing or neglecting the child? If you have or know where such evidence exists, you should contacting Child Protective Services in your County to advise them all of the verifiable information you know of so they can being an investigation.

The fact that she has been granted the adoption it would be difficult to challenge this. You would have to have absolute evidence of abusive behaviour, then you could report this person to Social Services. If the adoption has not gone through as yet you might stand some chance of objecting on the grounds you gave. The fact of an adoption legally means the child is now the responsibility, legally and every other way of the person who adopted that child.

If you have money, it's legally possible to challenge anything. Call a family law practice. If you don't have a lot of money, start by calling a social worker. They might be able to hook you up to different programs.
