I was involved in a collision with an 11 yr old on a motorized scooter. He ran into the side of my vehicle and after the accident was investigated by my insurance, he was deemed 90% at fault. The cost of my repair ($1124.36) will not be covered completely by my insurance as I only have a $1000 deductible. I would like to proceed to small claims court in order to be compensated for the damages. However, I would like to know what are my chances in a case like this. Please inform me if you can. Thanks.

You should have no problem collecting, but you will have to sue the legal 'owner' of the scooter. Since it was likely the parents who handed over the money to pay for it, they will probably be considered the legal owners. All you've got to lose is the costs of submitting your claim to Small Claims Court. Good luck!

your chances of winning are good, but of collecting?? If the kids parents are found to be at fault, your ok, but if he is at fault alone, not too sure you'll get anything from an 11 yr old.

I cannot evaluate this without many more facts. Just the statement of your insurance is NOT enough to make a good prediction. I suggest you consult an attorney regarding this matter.

You cannot sue an 11 year old.

Grow up and drive more carefully. When you operate a vehicle, you are required to look out for children and pedestrians.

You can not sue an 11 year old kid. You will have to sue his parents
