Can i personally sue condo owners for nonpayment civily, it takes tooo long to put in collection, liens , foreclosure. they are making my life miserable, I have prepaid for a year so that all bills could be met. they kick back and still receive amentities. with no repercussions and a chance that the bank will not be responsible for back dues. thanks i need help

No you can't, but you need to bring it up to the Homeowner's Association so they can start the processes.

When you moved in, you received a copy of the rules and regulations...and they have to be legally followed or the HOA is in breach of contract.

Start a petition and have your neighbors sign it...if the Board won't do anything, then next election time...you need a new board.

We have a condo board that deals with the attorneys, the management company, etc. with delinquent owners that don't pay their common charges. Do you have anything like that? If so, they should be the ones taking them to court...not you. Why should you have to waste your time and money on filing fees, courtroom time, etc. That's THEIR jobs! Also, get the other owners in your complex in on a complaint letter to the board or management company. There is strength in numbers. Good Luck!

You absolutely need to seek judgments and liens against their individual properties in order to insure that past due unpaid assessments are eventually collected. I think they will get the message if you deliver it properly.

While your act of paying in full for a year to cover expenses might seem sensible, you've given them NO reason to catch up with their responsibilities if YOU are footing the cash.

Get with the program and use the legal avenues available to yourself.
