is it a good sign when the insurance company calls my attorney to offer a settlement before we serve the ins company with a lawsuit

No, it's normal that they've already been in touch with your attorney... once the suit is filed, there are a lot of expensive steps to go through for both sides, sometimes a settlement saves everyone some dough (and sometimes you end up with more!)

Take a good hard look at the number they're offering, counter, dicker it, and take it. Bird in the hand is always better!

if your insurance company wants to settle right away, it may mean that you could be awarded more than what they want to give you if you win the lawsuit. depending on the matter and how much is involved i recommand you have a talk with your lawyer right away before responding to their offer.

not necessarily good or bad, sounds like they are in a hurry to get it over with but don't you let yourself be rushed into anything
