Why did I recieve a child support check after a year filing, then closing the case?

Question

I've never gotten a check before today. I filed Jan 2006 had to get on assistance in march until june 3 months. I closed the child support case in August 2006. Now I got a check and my ex is flipping out threatning to take my kids and get child support on me. The agency here won't return my phone calls and when I get someone they give me the runaround. im scared anyone know this stuff?

I'm thinking it must be back child support that he owed you.

I too had a case closed for over a year and then I received a check and it was the arrears that were owed to me. It came from my ex's state income tax refund. I got it instead of him. LOL

It sounds like it came from funds collected from dad during that period. If you still have the kids you should not have closed the case as he is still financially responsible for those kids whether he likes it or not. He cannot threaten to take those kids from you under no circumstances and on that alone you should reapply for child support. Unless the courts rule you unfit to be a mothe, dad cannot take those kids so dont worry about that and the courts would be interested in his threats here too. So you can calm down here as the law is on your side here and ready to help you if you decide to need the support. I suspect here that he made somekind of deal with you here to drop the support case in return probably for something thats to his benefit. Youre raising his kids so let him help you financially to do so. Its your legal right. Good luck

If it was me, I wouldn't spend it until I KNEW why I got it. It's easier to do without it, than spend it and have to pay it back.
