This Florida couple is suing a doctor for not diagnosing their fetus' illness accurately. If he HAD diagnosed correctly they would have mercilessly slaughtered the innocent child while snuggled safely in the "mother's" womb. (mother in quotes cause real mothers don't take a scalpel to their babies.. right?

Does anyone else want to move to the moon?

I was a fetus once. I have clear fetal memories..
I speak for those others like me.

I read this story a few years ago. Other than the abortion aspect of it, it's disturbing that the parents are basically calling this kid a terrible mistake that they would have gotten rid of when it was legal to do so, but now they're stuck, so they're going to at least capitalize on it. Awful people.

As a matter of law, there is no generally accepted legal claim for "wrongful birth".

Ignoring the moral issues entirely, since this is a "law and ethics" forum, the law does not allow the kind of lawsuit this couple is seeking.

At most, they can sue for medical malpractice, to recover the medical costs beyond what would be if the child's illness was diagnosed early enough. But that's a different issue.
