I believe it is legal to publish a classified document, it just isn't legal to leak a classified document. Basically, if you have access to a classified document as a part of your job, it is not legal for you to give others who are not clearly access to the document. The New York Times is not in violation of the law, but the person who gave the New York Times the document would be.

Publication of classified information is illegal, with the exception that illegal actions cannot be legally classified.

So, publication of someone breaking the law is allowed, because the statutes that create the classification system do not protect illegal activity, only legal govt actions.

As irresponsible as the Times is i am more concerned with where they got this classified document.

It is legal. Its called freedom of speech. It is not the responsibility of the FREE PRESS to censor itself, it is the responsibility of the government to protect its secrets. If they get out, so be it.
