My father won custody over my brother about 10 years ago. He is now 16 years old. My mother recently filed a restraining order against my father, as well as a restraining order for my brother against my father. Noone has any problems with my dad except my mother, my brother doesnt want the restaining order. So my question would be, how long does custody last, can she file a restraining order for my brother if she doesnt have custody of him, and what can be done to become a legal guardian of him? Thanks!

i'm sure custody lasts until he is 18. or is he gets emancipated from him. i dont thin your mom can file a restraining order against his father if he is living with him! good luck with that! but look up on google the laws for your state-- they vary

A custody order lasts until the child turns 18 or the order is modified by a court, which ever comes first.

It is likely the court will dismiss her petition for a restraining order against the father as she is not in a position to request one. If she suspects abuse, the restraining order route is the incorrect route to take.
