The FIA have overall authority for enforcing the rules. Who knows how much unofficial influence Bernie has!

While Bernie Ecclestone and FOM might be able to influence a decision, it's Max Mosley and his FIA team including Formula One race director Charlie Whiting who will always have the final say.
