What is the punishment for possessing marijuana? Are there any circumstances when it is legal to have it?

Simple possession of less than one ounce of marijuana is a misdemeanor carrying a maximum penalty of a $100 fine (which works out to around $350 with assessments). More than one ounce is a misdemeanor carrying a maximum 6 months in jail and a fine of $500 (around $1,800). An ill person can get a recommendation from a doctor to use "medical marijuana," which precludes prosecution under state law.

Note, however, that federal law still makes marijuana possession a crime, despite the best efforts of Congressman Dana Rohrabacher and others. I have not seen federal prosecutions for simple possession of small amounts of marijunana, but they are theoretically possible.

In CA the possession of marijuana is against the regulation below State regulation. in spite of the shown fact that, the "Compassionate Use Act" promises a protection to prosecution in case you have a written recomendation from a scientific care provider. The possession of marijuana, in spite of the shown fact that, is against the regulation below Federal regulation in all 50 States. Even in CA you will possibly properly be prosecuted with the aid of the Feds regardless of in case you have a recomendation, or perhaps scientific marijuana dispensaries might properly be raided with the aid of the DEA and the operators charged with drug dealing. It really doesn't matter what California's legal status is as it is against federal law!

Having Marijuana in Denver is legal, but still against federal law, which over-rides any state or local law!

Depends on how much, and whether it was for possession or intent to sell!
