Can you tell me how a daughter or son of a mother that is witowed take a loan out on her house with out her signature at the signing?

My stepdad his mother died and his sister took a loan out on the house with out his mothers signature how could she do this?

You would have to have power of attorney, otherwise for a person to take out a loan on someone else's house that would be fraud. And if the person had a power of attorney they would have to account for what the money was being spent on, if it wasn't spent on the mother or on the house they would be liable for those monies.

Unless they are on the deed or have power of attorney for the owner of the deed, that is illegal. It probably required a forged signature.

You can't. If you aren't on the deed you can't take a loan on it.

why would you want to screw your mother like this??? she is YOUR MOM....try to get a grant.
