My husband and I were trying to file child support against his birth mom. She has to pay for her other two kids that the state took. When we tried to get some child support they said that she didn't make enough to pay to his son. Why dose the state get child support from her ,but not her son who lives with us? We live in the state of Wisconsin.

Any time a child is a ward of the state, the state will always take a portion of a non custodial parents wages in partial payment for their care. It is likely that she does not earn enough to qualify as having the means to pay actual "child support" for her son that lives with you. Sorry, but the state comes first.

Probably because the boy is in the custody of his father while the other children are being supported by the state and in case you didn't notice the government get's their cut first.

Because the state gets their money no matter what. She probably has a job that doesn't pay much and they get what they can out of her. You can't get blood from a turnip.

Each state has different laws. Sounds to me like you need to consult with an attorney.

sounds like you need to go to court. Everything needs to be laid out in front of a judge.
