ok, so i was supposed to have my patio done by the end of june (june 21 to be exact) and my contractor has only dug up some dirt and put a small wall around the to-be-patio but nothing else. i do have a solid contract (b/c he also painted the walls and did a backsplash) with deadlines as mentioned above.

my dilemma is that i'm having a housewarming BBQ with over 40 ppl in less than 2 weeks. this guy is getting on my last nerve...he shows up for one day and then is gone for 5 days. how do i deal with him!?!??!! PLEASE HELP! i'm going to have a panic attack if he's not done before my 40 people BBQ!

no, we have only paid him $500. i REFUSE to pay him until he is completely done. i would LOVE, LOVE, LOVE to fire him, but how can i get someone to finish his sorry-a$$ job in less than 2 weeks? he is so unprofessional...like today...he said he'd be here in the afternoon and didn't show up or call. when we called, it went straight to voicemail. my husband has way too much patience and says that we have no options (true), but i sure want to do something...perhaps once he is (hopefully and finally) done. what suggstions do you guys have? can i NOT pay him the full price since he is totally unprofessional and 5 weeks beyond his deadline.

Turn him over to the contractors state lisc board in your state.
File a complaint with them...call them and tell them what it is for. Make sure you have his contractors lisc number and the name of his insurance co.

He is suppose to be bonded. You can sue him for the $500.00.

You should get some legal advice first tho.Have a lawyer look over your contract to protect yourself.

The contractor is the one that has broken the contract by not completing the job on the date on the contract..

You can call another contractor to finish the job but only pay the material bill.and that is directly to where he bought the materials . Pay him when the job is done to your satisfaction.

With only two weeks to go, sounds like you'd better think of some alternative to a BBQ. Meanwhile, please tell us that you didn't pay this contractor in advance. Also, any contract for such work, but most especially if personal plans depend upon the work being done on time, should actually state "Time is of the essence". It should then go on to provide for daily monetary penalties for each day that the contractor goes beyond the stated deadline. Good luck.

the best way to deal with him
if you have not paid him anything

call him up and fire him

he will want to know why
tell him exactly why

if he is reputable he will run to finish

if you have paid already
then you have no leverage and may never see him again

in this day and age i would hope people have learned to never pay for more than the materials till the work is finished
