Not illegal. Not unless you struck oil and tried to keep it. Mineral rights refer to just that....minerals. You have surface rights to your land.

I am not an attorney. But here in Texas we have been to several seminars on mineral rights lately because of the natural gas drilling going on here.
One of the attorneys said that stuff that is within fifty feet of the surface is not covered in the mineral rights laws in Texas.
