As the leaves looked like mint and had I not smelt it i could have used it in the cooking. This plant is poisonous.. My question is do I have a case against the supplier.? They have offered to replace the packet of seed.

Did you indeed use it for cooking and get sick? If not than I hardly think you have a case.. If you did you would have to provide a doctor's exam/diagnosis that says you were "poisoned by nightshade" and missed work slips etc... The company offered to replace your seeds than that is fair.. In the future buy the actual plant and plant it in your garden...Instead of the seeds.... Good luck

Are you particular those are from the seeds you planted? it might desire to nicely be some weed which grew the place you place you mint seeds & snuffed them. placed up a photo of this plant, i'm particular somebody would be waiting to reconize it & strengthen greater help.
