I am going to texas to visit my daughter's father's parents. he has only seen her a few times her whole life she is 18 months old. He wanted a DNA test when she was a few weeks old we had our mouths swabbed but he never had his. Now that he is moving and trying to get a job with the Texas State Troopers he wants a dna test when we go down there....Is there any laws in texas about child custody that could cause me not to come home with her?

The "Uniform Child Custody Jurisdiction Enforcement Act" determines which state's court has jurisdiction to decide the case when parents live in different ones, so just being there will NOT subject you to court jurisdiction. Just to be sure, I would pack a copy of the all papers from your local court.

There is no reason for you and the baby to be swabbed again. You two are done. He needs to do his. You should file a motion for contempt or enforcement to make him get the swab that was ordered already. If he's moved, he can get a local lab approved by the ocurt and go to there and have his result sent to the first one for comparison. It's done all the time.

It could be harmless request that he is asking you to go, or it could be a set up and if he gets the DNA test and it is positive, file for full custody and show he is now the more "stable" parent as he is going to be Texas State Trooper and has the support of his family who will take care of his daughter while he is a work instead of her single mom. Is not worth the risk to find out.

Don't go until there until he submits to a DNA test in the State where you currently reside and a formal custody agreement is in place.

I'd refuse. Why do him any favors? If you're concerned about custody- don't worry. Most courts focus on the parent that spent the most time with the child. If this is to prove or disprove if he's the father, let him sweat it out in court.

go the state's web site and look under child support laws etc.they often have good back ground info for you to read..this is a hard one to reply to as each state has different rules laws etc.

BUT if you have legal sole custody and have this in court papers then I would assume he has NO leg to stand on.

I would be more curios as to why..........it does not sound right that JUST cos he is going to try out for state trooper that he is trying to rush the DNA tests now................and what is his reasons for not having it done before........
