Employer pays which ever wage is higher.
for example:
fed min wage is : $5.85
State min wage is $6.25

employer has to pay $6.25

They have to pay whichever is higher..the federal or the state. Federal minimum wage is based on nationwide figures. States can look at more regional info and use that to decide if the federal amount is generally insufficent and opt to pay a higher wage.

If you are talking about minimum wage laws, the federal law states that someone cannot be paid less than $5.85 per hour.

The state laws vary by state, but let's say your state mandates that someone cannot be paid less then $6 per hour.

Since it is possible to obey both laws at once (they are not in direct conflict), the employer would be required to obey both at once -- the employer must pay at least $5.85 and at least $6. Which means the higher minimum applies.
