(illinois)the owner of the car was driving on a suspended licence she came to a sudden stop when she realized she missed her turn i was going about 30-35 and attempted to avoid the accident but was not very successful,she attempted to leave before the police got there to avoid getting arrested but failed, i did not have ins,also the car i was driving is not mine. for the past week i have been trying to figure a way to settle with this lady but one minute she is willing the next she threatens to sew myself and the owner of the car,this lady calls both of us 4-6 times a day sometimes she is willing to have me fix her car or buy her replacement,the next she goes pschyco on us and threatens us,i am so stressed out,i want to work with her to get her off my back but she is not willing to give me a paper stating upon repair of the vehicle she will no longer pursue us,she even had someone claming they were her attorney call me from a cell phone when i asked his info he did not give it to me.

I have to pay extra on my insurance to protect myself from people like you who drive with no insurance. Your getting what you deserve

I am a licensed Illinois Insurance person. Here is the thing. Insurance follows the car, not the person driving it. So, if I borrow your car, and I crash it.....my insurance doesn't cover the damages. Your insurance would. So if you weren't driving your car, the insurance isn't yours to have. Did the person who owns the car you were drive have insurance? If so, then that policy would be the one to pay out in this case. There is no doubt that you are liable for the damages as it was a rear end accident. But, you really should check into if you friend had insurance, and if they did, have them call their agent with all the info and file a claim. Then you can tell this other party to call "state farm, allstate, whoever" and you will be out of it.
If there was no insurance on the car at all, I hate to say this, but you are going to have to find a way to pay this lady for her damages, or risk being sued. In Illinois, it is illegal to drive an uninsured vehicle, and you are liable here.

You could have protected yourself by calling the police and making a report. Yes you would have gotten in trouble for not having insurance, but now you will probably face a bigger program with this woman.
I suggest you get a lawyer. Do not handle anything over the phone with this woman. Chances are when she sees you have a professional attorney involved she will back down. She can not take the law into her own hands.
Make sure you keep a record of this person's harrasing phone calls and document EVERYTHING.

If her license was suspended, then she has no right to be on the road.!! She can be & will be punished by court of law to serve time in jail like Paris Hilton !! Yet you don't have a right to drive a vehicle without insurance? Your Driver license will be suspended for few years,and you'll be fined also.there was no reason for you to drive without Insurance. Just for people like you I Have to buy uninsured motorist policy to protect my self & My Family !!

Unfortunately, I have to say the ball is in her court. Neither of you should have been driving, but financially she has the upper hand.
I'd get an attorney, and fast.

The next time she says she is willing to settle, make her put it in writing. Say the offer is only valid if she puts it in writing. I would get a lawyer if I were you. Good luck!
