will she be accused of abondonment of home if things come to a divorce ? The thing is she is being cheated on.

Its the state of Texas and I believe that in the state of Texas even though the spouse is not on the mortgage you are still part of it.

Yes her husband can file for divorce based upon abandoment. She needs to stay put and tell HIM to get out. The fact that she is being cheated on is a moot point since most courts do not recognize infedelity as grounds for divorce any longer.

Is she leaving for the safety of herself and the children? She should go to court to at least file a legal seperation otherwise she could be charged for taking the children, not abandonment of them I believe.
I wish her well! This is never easy.

if the house is under her name tell her to make him leave..
if its under bith there name take his things and put then outside tell him thathe has to go.

whose name is the house under, she might want to talk to him first, in case something should happen to the house

it's better if she stays..... she will not be accused of abandonment, but she will have less rights. she might loose her alimony and even get less child support depending on her less expenses...
