They are adult children and they are all listed on the lawsuit. The lawyers got 40% and the rest went to the plantiffs. They did not separate the money so it is up to the spouse and children to figure who should get what. The mother thinks she should get all the money. It was given as pain and suffering so it is one check that is not taxed.

Morally, in my opinion, it should be split equally if both spouse and children were plaintiffs in the suit.

If all parties are named in the suit, they all should have use of the money. Depending on how much, put some in a trust for the children until they are of age to use it correctly. The mother should be able to use it of things that will help with the raising of the children. The mother should also have some for her to use if it is both that won. I would advise going to an investor who has dealt with this type of scenario and have the money divided as necessary and invested to have this for income when it is needed.
It is a shame the money had to come from a bad situation and I hope you both get the help for healing. I wish you the best.

I think usually they break it up separately in the suit to begin with. My friend is currently going through a suit over her dad and her, her mom and her brother are all separate plantiffs. It makes sense that way.

She can sue for whatever she wants, as long as she has provided accurate information, which she probably will do. I don't know about the clown face video with Anna Nicole Smith, but it could have come out before she had died, long before. If it's come out recently, then maybe her death has messed up Howard K. Stern's mind so much that he's started doing crazy things. Hopefully he'll recover soon enough, he is such a sweet man!

The mother of course, because she need to take care of her children. And, if she is a good mother, she will definitely put some on the bank for them.

Both, the mother and the children. She has to continue raising the children yet they also need college funds......If she is any kind of mother she would already be thinking of their future.
