Smoke billowed up sides of car. Got out with child and pet. Reputable mechanic determined that wrong engine oil filter was used causing all the oil to come out. There was no oil in car when arrived in mechanics shop after tow. Est. cost to replace with new engine $5,700; used engine $3,700. Car is 2001 Camry with 73,000 miles. Need advice. How am I made "whole"?

I was extremely lucky years ago. Went to national oil-change place, and just before they brought out my car, they discovered they'd put the wrong filter on, so I'd have ended up like you!!

Definitely sue. Try going to ""Handel On the Law.com" (minus any spaces), look up in your area a lawyer who will give a free estimate or appraisal of your case.

But I noticed you didn't say WHO had changed the oil. Obviously, if you did it yourself, you're out of luck. If a business did, then sue them.

But if there's no one to sue, then just get another car. Don't think it's worth the hassle of getting new engine. To me, the car would always be "tainted". I wouldn't have faith in the car anymore.

Did you get a oil light that came on? That would have been the time to pull over and shut the engine off.

I would contact the people that did the oil change and see what they say. If they don't accomadate you, then it is time to file a complaint with the BBB and then to contact a lawyer. Get a statement from the mechanic that determined that the wrong oil filter was used. You should have a good case. good luck.

Sue the shop that changed the oil. Either wrong filter or the old rubber gasket was stuck to the engine & they didn't remove it before putting on the new filter. Tell them you want a new engine, they will probably settle for used.
