A Democrat would likely repeal the MCA -- if the Court hasn't already struck most of it down.
The Patriot Act is obnoxious and intrusive, but it's not unconstitutional, and we're going to be stuck with it for a long time.
But yes, I think any future president is going to like being able to refuse to answer Congressional subpoenas, and being able to refuse to follow the law whenever they want.
And now that Bush has set the template for how to rig the Justice Department to be immune from prosecution, I can see many future presidents of either party using that trick.

I think one of the first things the next president will do is to issue executive orders directing all branches of the federal government to protect the rights of individuals under the constitution. I think the Patriot Act will be significantly revised and renamed, and the Miltary Commissions Act will probably be allowed to expire. But I also believe that when the new president gets briefed on all the operations currently underway in the intelligence community s/he will feel a need to hang onto some of these tools to fight terrorism, even if they are used with more discretion.

If Hillary gets in heaven help us! Instant socialism as executed by a totalitarian police state, like Russia used to be. But think of the good that could done if Dr. Ron Paul were to get in! I dream of all CFR and Trilateral commission members being rounded up as enemies of the state and put into one of their FEMA concentration camps. Anyway it is a nice thought. No IRS, no fed reserve, no FDA, no homeland security agency and no CIA. The FBI could also be cleaned up or disbanded. The list goes on and on.

I think they will love it. Dont even bother with the Patriot Act, just look at his Executive orders for everything. Get a good socialist style person in there and youve got all the makings for fascism- socialist ideas and a gov't that cant be held accountable for anything--now lets all remember to thank Bush for failing to look beyond his own time in office.

It's all about balance - we have to hope for it, and try to be sure our elected representatives appreciate we are concerned about it, including the checks and balances provided by the Constitution, which is the best document ever drawn up to try to run a country under, and get rid of any that won't listen and act accordingly!
