I think you should do a Google on Ramos & Compean and read the testimony of other officer's at the scene and the US attorney's statement, which was publicly released.
The rules of engagement for border patrol officers state that they may use deadly force to protect their life or the lives of others in the execution of their duties. No law enforcement officer is legally allowed to shoot an unarmed suspect in the back (buttocks in this case), as that "fleaing" suspect poses no threat to life.
Now, as far as committing a crime with a firearm, that is a Federal Law, that there are no exceptions in for wrongful use of a firearm by a law enforcement officer, however, I believe that if the use of the firearm is the alleged crime, then it falls outside of the intent of the law.
The intent of the law was to make harder sentencing guidelines for other crimes using a weapon, like robbery, burglary, rape, etc. For this reason, I would not be adverse to the setting aside of the enforcement of that Federal claus in the law, but I still believe those officers violated the law as well as many departmental procedures and deserve to have consequences to their actions.

Should he? Yes. If I were President, they would have been out with their full pay right now. But with Bush, three things work against commutation or pardon on his part:
1) He has little to gain from it. Scooter has stuff on Cheney and Bush. Ramos and Compean do not so why lift the finger
2) Johnny Sutton is Bush's former AG in Texas (Nepotism raises its ugly head) and setting then free makes him look bad. Even if the prosecution was a sham and Sutton needs to lie to keep them in there, to let them out would make him look like the fraud we know he is already. Remember when he said, "They were out to kill a Mexican" and had to back off of that because no one had heard them ever say that?
3) What better way to make the border patrol look the other way than to take a 2005 candidate for border patrol officer of the year and throw him in prison? Bush wants the border wide open and the border patrol doing its job throws off his groove.
As Bush sees it, Ramos and Compean have to stay in Jail at least 18 more months, barring a real nasty lie from the prosecution's case coming to light.

I think that if people break the law, they should be punished under the law. That goes for everyone who commits a felony.
Commutting Libby's sentence was a mistake -- politically -- because it sets a precedent that any future president should be able to pardon any future aide who commits crimes of perjury. Which cripples the entire concept of accountability for elected officials if they can always lie and then get off without penalty.
The two border patrol agents broke the law. As determine by a jury of their peers. And were sentenced under the law, which required mandatory minimums.
If we are going to live in a system where the laws shouldn't ever apply if people are popular, or if we like them, or if we think they were trying to do the right thing -- then we should throw out the lawbooks right now and everyone should start taking acting lessons. Because it will always come down to how popular someone is whether they are punished. That's not the system that I want to live in.

The Bush/Scooter Libby situation aside, do you really think that it is a part of law enforcement officers' jobs to shoot at fleeing suspects?
I was under the impression that police are to only use deadly force when the safety of themselves or other citizens is in immediate danger.
Is this the wrong impression?
BTW, did the officers know that the fleeing suspects were drug smugglers at the time of the shooting? I didn't think so.
Also, if they thought they were just doing their job, why the attempted cover-up?

Criminal that the fleeing suspect was an informant for the dea and has special protection and that he demanded the border patrol guys go to prison .
Actually they are on a paid vacation in a warm sunny spot and the prison records are manufactured .
I can not belief for a minute that they would jail these guys for doing their job .

They should never have been prosecuted or tried kiddo. But the President is insane over this border issue. I truly believe he wants the Southern Border open and I think he cares more about protecting his position with Mexico than he does about his own country. This is the biggest issue which has made me cycle back my support for him in the past few months.
Don't get any ideas Leftists I still like Bush a hell of a lot more than I like you!
I have emailed the White House and called about a dozen times to get these guys out. I have contacted my idiot leftist Senator who happens to be Mexican and low and behold he thinks these guys should be in jail as well, go figure. I don't think anyone is listening to the public on this issue. Which isn't surprising as 80% of Americans were against the latest Immigration Bill and it still went to a vote. These politicians don't care about you, don't care about your opinion, they think you are sheep. I'm talking about Dems and Reps alike. And these two brave Americans are gonna rot in jail.

What's good for the goose is good for the gander. That's an old expression. President Bush has tunnel vision. He and Vice President Cheney are looking out for their friends or themselves. Thus, you see if Scooter Libby goes down, so will they. Since selfishness and "protect one's self" play a huge part in today's politics, these two guys aren't considering any jail time for themselves. Thus, Mr. Libby won't be treated too harshly in the near future or ever. Anyone else who deserves a fair shake with the system better have something on someone as in "blackmail information" or know someone with serious clout. Otherwise, it's business as usual, and no justice will be meted out even though a person is entitled to it. Remember this, What shall we then say to these things? He is an idiot. First if he can get his sentence erased then he can not testify against him and Chaney. I little hint of what is happening. Those men needed to do what they did... Do you realize that you get more jail time for Maryjane then you do for murder. Yes, my boy was murdered by a gang member and he left him to die. Hit and run. Then fixed the car, got a ticket, went to the highway patrol and to have the ticket written off and from body pieces under his car. Busted. They did a plea bargain and he got 5 years. The system sucks!!!!!
