You need to go before a judge. If your spouse is not to be found. The judge can give you a divorce without him. It might take a little longer but, might be all you can do. Do you have a lawyer yet? They will know more then us.....Good luck

You shouldn't have to wait very long. If you file for divorce in my state, the defendent has 30 days or so to file an answer with the court. If they don't the judge may grant the plaintiff the divorce and award them all their wishes stated in the complaint.

It depends on how long he has been gone. If he has been gone for a long time that is considered abandonment and the procedure for divorce will go faster. A judge can grant you a divorce whether he shows up or not as long as the reasons for the divorce are uncontested by him (your husband) there should be no real problem.

I don't know what the statutes of limitations are, but if you show up for court and they don't appear, the judge should grant you one without their signature.
