Like it or not, Britain (and therefore Scotland) is a member of the European Union. Its member states have agreed by treaty not to use the death penalty. Even if Scotland becomes independent, it will probably choose to remain in the EU for economic reasons.

i don't think so. As already mentioned Scotland is a member of the EU; this organisation bans the death penalty. Besides the death penalty is barbaric practice it, only uncivilised countries use it: America, Iran etc.
