Giraldo is suing the state prison system and several guards over the state's policy of assigning inmates like her to men's or women's prisons depending on whether they have had a sex change.

"Prisons are violent places, and male prisons are especially violent places," said Greg Walston, a lawyer who took Giraldo's for free and asked a jury this week for unspecified damages. "You take that boiling cauldron and you put one woman in there — which is exactly what happened here — and it's like throwing a fresh piece of meat into a lion's cage."

Giraldo, 30, claims Folsom State Prison guards ignored her complaints and returned her to the same cell until she was assaulted again, then placed in protective custody and moved to another facility.

If a woman tells you that she's been raped, and she tells you who it was, and that this man intends to do it again, would you lock her in a room with him? And if you were so inhuman as to do that, would you be surprised that she sues you for doing so?

Alexis Giraldo is a woman; she was born with a congenital condition, Benjamin's syndrome, also known as transsexualism. Putting a woman (transsexual or otherwise) in a men's prison is unacceptable.

Naturally people will tend to stare unknowingly at things that they don't get to see on a regular basis or something they can't have. So its not rude unless you are doing it intentionally to make them uncomfortable or knowingly doing it for minutes at a time. As for the comments being rude like the "hey mama". Really it all depends on the person. But the fact that the females in question are counselors in a prison system I'm sure that with all the staring and comments being thrown at them that they are very uncomfortable with it. So if you know you are starring your best bet would be to just stop and find something else to focus your attention on as hard as that might be in your situation.

My thought on this...don't break the freaking law and people like this won't be put into compromising positions. I am a firm believer that no one should be raped and that once officials were notified that this crime occurred that Giraldo should have been place into protective custody. But to sue the state.........who put Giraldo in prison....Giraldo...right!!! I don't think that this person should be given any type of monetary compensation...NONE!!!
Men who are not trying to be woman are raped all of the time.....they do not get reimbursed!!! I do think that charges should be filed on the alleged cell mate and at the very minimum the C.O.'s who put Giraldo back in the same cell should be reprimanded. But please by all means.....do not pay this person.
BTW if Giraldo, has a penis then he is a man. So I do not think it was a violation to put him into a men's facility. So, he was going through the change to become a woman(his choice)......he should have thought of that before he broke the law so badly that he had to serve state time.....

Frankly the state followed the rules and put her in teh right Prison, because he has male genetalia. We can't put people in seperate prison because they act feminine. People would start putting on an act like Klinger on Mash to get out of prison. Prison is not suppose to be a friendly place.

It sounds like this will cost the state a lot of money. Giraldo was repeatedly sexually assaulted yet the corrections officers did not move her/him to another cell. I do NOT think a defense they were just following policy is going to be much of a defense. A jury will eat them alive!

One of those situations which is trouble no matter what you do.
I guess we need a law that says when in doubt we will do a DNA test and if says you are a guy, then thats where you go.

I'm going to say it like it is.

Simply put, she has a penis. "She" is a "he." Even men without gender identity issues get raped in prison. This is not a singled out "oh poor him" case.

We owe "it" nothing.

I am incredibly angry that she was not protected, and I think it is ridiculous to determine someone's gender based on what is between his or her legs, especially in a clearly abusive situation like this.
