he got custody only because he put me in placement wouldnt it have to go back to court to see about custody now of my 4 year old daughter?

If you are an adult and can demonstrate that you can provide a safe, loving home for your child; you can sue for custody. Are you employed? Are you sober (no booze or drug problems)? Are you married to a decent guy? If single, can you work and maintain a home for the child? Are you healthy, is the child? Do you have health insurance? Is the home you are going to bring the child into comparable to where she is living now? There is a lot a stake here for you but even more so for the child. Be sure you are not going to make her life worse, just to make yourself feel better. I know that sounds harsh. I know of at least three cases where a young mother regained custody of her child. All three were living with parents or grandparents in clean, healthy homes, with plenty of care. One went to a roach infested apartment in the worst section of town, nearly died of pneumonia. Two others wound up in Trailer Trash City. The mothers may have thought they were doing the right thing but one nearly killed her child and the other two were absolutely miserable. Be sure of what your are doing.

Yes, you need to go back to court. I suggest you hire an attorney. If you can't afford one, apply for Civil Legal Aid. You can get information on how to apply from either the clerk of your local court, or your state's Bar Association web page.

The Judge will look at what is best for your daughter not either of you. Custody is never permanent unless adoption occurs

See a lawyer. You will not get a good answer here more than likely and this is far to important to mess around with.
