We are builfing in a neighborhood that has an HOA, but our lot was never signed in. Long story short....it has never been signed into the HOA by any owner. We are definitely not a part of the HOA, but the neighborhood does special assessments from time to time. Would we be obligated to pay for special assessments. They special assess everyone in the HOA, but if we are not a part of it....can we get assessed too??

You may need a lawyer to find out. If there was NO HOA present when you moved in, one was started, and you didn't join, you are not OBLIGATED by law to join, nor can they force you. You have to sign your rights away. You'll have to have your deed gone over to be sure, if you don't know when your local HOA was created, or whether you signed up inadvertently.

You may be in the HOA and not know it.

Odds are your deed contains a phrase like "acceptance of this deed is acceptance of membership in the HOA", and if it doesn't, it's probably in someone's deed in your chain of title, which means you're in the HOA.

Yes, they usually can. This is dependant upon the covenants of the individual neighborhood in which you live, as well as the ordinances of the city/township you live in (if any).
