That I am acting as guarantor of. I decided to go into a contract with a person who paid me well to act as guarantor to secure a property. The problem is I cant reach her and I have been interested in getting keys to the house to check it out. I know its dumb that I never have taken a look at the property because at the time I didnt want it, but now im thinking maybe of moving into it and using it for my own personal benefit since it is mine. My question is, where can I get keys from it if she is no where to be found since it is my property legally?

You're a landlord/lender, and have no right without written permission, or advance notice to the owner, that you intend to enter the property. Did you file a lien against the property, or is their a trust deed in place? Something smells real bad in this situation.

Speak with the title attorney first on your rights. Is your name on the deed? Loan? Does the REALTOR who sold the property still have a set? Is the buyer living in the house? Are there issues with payment? You may find that there are ownership issues if you wrote this agreement with an option to buy clause. In Texas an option to buy clause and you did mention that this buyer that you guaranteed did give you a substantial amount of money to be the guarantor... the option situation places them in the position of having ownership rights in that scenario. Check it out before you step into a situation that may well be a bigger problem than you might first think. If all is well in your state and the REALTOR doesn't have any keys, there's always the locksmith. Just because you can doesn't mean you should. Tread carefully. Good luck.

Sounds like you were being used as a straw buyer and this is highly illegal. Since you are legally on title, call a lock smith and have all new door knobs with keys made for the house. It will probably cost you quite a bit to do this.

I think I would look over any contract you have with this mysterious person. What and how you describe is very unusual. Be sure you are not being taken for a ride.pp
