No, it's not an ethical dilemma -- it's flat out unethical. Why do I say that? Because if someone has sworn an oath to uphold the laws, then orders illegal activity, that's obviously a breach of ethics as well.

There have been laws on the books for over 30 years allowing wiretapping of foreign terrorist subjects. And under those laws (18 USC 2511), the authorities can even begin the wiretapping immediately and apply for a secret warrant (nobody ever knows) within 72 hours AFTER they start.

Bush just didn't want to be bothered following the laws. There's nothing he did illegally that he could not have done legally. And choosing an illegal option out of hubris -- that's unethical.

Like most every aspect of social life, yes, it presents ethical issues.
