I don't know about the rest of the country, but here in Michigan
it's a felony (as it should be) to put bodily fluids on food sold to
the public. There was a case I read about in the paper where an employee did that on a sandwich ordered by a police officer, who promptly arrested the punk. What a dumb-***.

By the way you presented this question, to me it sounds that you are either the owner of the restaurant or are in charge. I would suggest that you have a chat with him and then have him either disciplined or dismissed. With that kind of behavior I think it would be wise to let him go. If word gets around your establishment could suffer business tremendously. As a result whether you are in charge or not the business may go under and you will be out of work either way.

tell the manager and call the cops, he doesn't need to continue working there. that is so disgusting, could you imagine if you would have taken a bite of that. my husband worked with a girl who always checked everything she ate and drank out, and one day she went to sonic and ordered a drink, she opened the lid and there was a big mucus like blob in it. so she brought it home and froze it, she knew people that worked in forensics, she later brought it to them and had it tested and it was a big fat lugi, so she had the guy who fixed it fired and pressed charges on him.

If the burger was for himself, fire him.

If the burger was for anyone else, fire him. You may want to call the district attorneys office to see if he can be prosecuted as well.
