So this is crazy and I was wondering if anyone hear can answer this for me. My best friend married her husband about 3 years ago. They went to Reno and did the thing. They got their marriage license before and everything. She is looking to divorce him but she remembered that shortly after their marriage she was suppose to mail some thing back out to Reno. I donno what it was but could that have cause her marriage to be invalid?She going to the courthouse to file for a divorce but I was wondering myself because it just seem all too confusing for me

Two things here:

1. In Nevada, the person performing the ceremony is required to record all the certificates, so even if your friend did not send anything back to Reno, chances are that all the proper paperwork was nevertheless filed and recorded correctly.

2. Even if the marriage certificate was not recorded, in most, if not all jurisdictions, the marriage is still considered valid. In other words, once the marriage is licensed, solemnized, and the certificate is authenticated, failing to register the certificate with the recorder is a technicality that will not invalidate the marriage.

It should not be confusing!

After you are married usually the person officiating sends the formal documentation of the marriage back to the city clerk, who records it and sends it to the state Vital Statistics.

Sometimes they give you the paper work, or the person getting married the paper work. If they fail to record it, or send the paperwork back to the city clerk, no official marriage ever took place! It is impossible to divorce someone you never legally married!

If she got the license, it's as good as done. Maybe she wants to have an annulment instead.
