I was arrested, convicted, & sentenced to 6 months house arrest & 2 yrs probation. I was a part of a BIG insurance scam in Brooklyn(made front page in the NY Daily News). Never even had a ticket in my life b4 this situation.I'm stuck with an E class felony for the rest of my life,owe the gov't$5,000 in restitution(not including the court fees which I've already paid off). I had been a law abiding citizen all my life and I never made any money or even stuck around to get a claim from the insurance co. and I only did it because I was homeless at the time and the person who let me stay with her said I had to do this if I wanted a place to stay.My racist JudgeJudy-like judge said she was making an example out of me-but then 1yr after my conviction, she let a White guy go with community svc for the EXACT same charge because he had a famous name(that made the Daily News, too). Based on these facts, you think I can get the gov't to overturn my felony & bring it down to a misdemeanor? Thanks!

Also, the judge was aware of my homelessness through the pre-trial report where they got all my records through the shelters I'd lived in. They did a full-on background check on me and even found about how my mom was abusive and kicked me out and I had no place to live from the time I was 17 yrs old(through ACS records). This Judge knew my ENTIRE life story and still gave me the screwed up sentence she did. What's up with that?

You could have (possibly) plead down at the time of the charges. You might even have been able to appeal immediately after your conviction.

Now, it's too late to change things retroactively.

You situation sounds rough but you probably wont get any help with your situation. You may want to write thegovernor and ask for a pardon that is the only way your conviction can be downgraded after the fact.

The sentence is to make an example of you..but maybe your attorney can get the felony reduced to a misdemeanor if you complete all your probation requirements and stay out of trouble.

No, the only way to get it reduced would be by having your lawyer talk to the judge...retrail...resentencing....(a lot of hoops youd have to go through)..but most likely... it cannot be changed.
