quick history: i am 38 widowed with a 10 yr old son.who lives with me.....her no kids never married till now for a yr to me she is with child due march 2008... we are renting atm and looking to buy a house... my question is there a way i can lock my son into 1/2 the house if i die so she cant write him off.?.if so who do i talk to? and when? while buying ?before we talk to a realtor? she is very aware of this and how i feel...You hope you marry someone who will do the right thing but it does happen...( i dont think she is this way)....if i have to leave the house to her is there a ironclad contract that we can sign saying she will not cut my son out...i already have a 250,000 life insureance for him and 500,000 for her... all i what to do is make sure my son gets his share after i am gone.. when the baby is born i will open up a 250000 life insureance for her/him.....

i have a will and planned on writting it..but wills can be contested and i planned on talking with a lawyer just looking for an inside track that would help me get to the heart of things faster....

i do trust her or i would not have married her but i have seen siblings tear each other apart over a few hundred dollars/ and people remarring and screwing there own childern... it is not and issue of trust it is more about just securib=ng his furture and the new baby well get they share but if i die i am hoping my wife will not cut out our child but might cut out a step son

The only sure way to have a guarantee and not to upset your new wife to be is to have her sign a pre-nuptual agreement. If she truly has no problem with your child she will see no harm in signing. If she hesitates, you may have other problems that you are not aware of at this time.

Seems to me you don't trust your wife. In some states if you die without a will then your son could possibly get half of your half....not half of the whole. But then you will have another child so that would be splitting your half two ways between the children. You wife needs protection for her future. The children will grow up and have jobs.

You will want to see a lawyer and perhaps do a prenuptual agreement if you wish and a good well written will to see that the things you want to happen will happen.
