My bro left his wife for 2 days because she kept their children in the same dirty diapers all day and wouldn't clean house. She took their 2 yr. old downstairs to mom's and left the 1yr old in the playpen all day. He went back to clean because she didn't clean the house and change the kids again and mom's really upset. He decided to stay to make sure the kids are taken care of and to get her to leave the apartment because she neglects the children while he is at work or she leaves them downstairs at mom's all day. Now she wants him to stay gone so she is going to lie tomorrow at the court clerks office in order to get a restaining order so he is not allowed at his apartment or his mother's because he live's upstairs from her. What can he do to get her in trouble for filing under false pretenses?

He did go back and try to stay for the sake of the children's welfare. He did tell her when he left if she didn't clean up the apartment, he was going to call child protective services on her himself. Then his mom told him he had to clean the apartment because she still had done it and when the kids got up, they had the same diapers on that he put on them before he left at 4:30 the afternoon before. He cleaned up the apartment and decided to stay with her long enough to get her out and take custody of the children because she doesn;t want to take care of them. Now she has decided she wants him gone and he doesn't want to leave the kids with her nasty butt so she's going to get a restraining order tomorrow morning just so he will have to leave the apartment. Will the court give him the kids if he has to live with my husband and our 4 kids until he can get his own apartment? He doesn't have anywhere else to go. His parents live below them so the restraining order keeps him from there too

If the false pretenses can be proven, then the court can take appropriate action.

But sadly, people have been lying in courts for thousands of years and getting away with it.

One of the reasons that out of 10 things to condemn, "bearing false witness" was on the list.

he needs to be at the court,with a lawyer,,,the best thing for him to do is to retain a lawyer and get custody of the kids.If he doesnt' then child welfare can get your kids,if they see them in that condition. I don't think they can keep him from his mother's apartment...but he needs to take his kids,and if they are his kids,it is NOT kidnapping.Take them away from her and move somewhere else,or leave them with his mother while he is at work..and forbid her from visiting them.Obviously she doesn't care for them,why would she want them?? She needs to go to work and leave them in a daycare...that would actually be better for both her and the kids.

he needs to call child protection for neglect if he loves his childern as long as he has people on his side he will win custody. them poor childern needs help not the father. he needs to help his children nothing stands if proven false!

If you can prove it is false then no, It is proving it that may be difficult.
