The posters above are missing the point of the downloading cases. They are - without exception - CIVIL cases, lawsuits seeking money damages. They are not criminal prosecutions. Thus there is no jail time.

I suspect because they come from a market that no one in this country can touch, and if they do, it means they have been listening to you illegally and without a warrant, which is constitutionally required, no matter what Bush says or does! That means it would be thrown out!
I imagine they go after the sites all the time, but they must change their addresses a lot!

They're not necessarily being punished with jail time, it's mostly really expensive settlements that people are going to be paying off for a really long time. Read up on the RIAA and MPAA, they are out on a rampage and suing hundreds of people per month, thousands per year. If you want to take your chances, that's your own choice. Don't think it's not possible to get caught, though.

Because it take several years for the prosecutions to run their course, and the major push only started a few years ago.
But we've seen quite a few prosecutions -- most people just plead guilty and pay the fines to avoid the risk of jail.

Most of the time, if the people are only "stealing" the movie for themselves, the law doesn't even care. It's when you download to mass-distribute - whether for personal monetary gain or just so your buddies don't have to buy Talladega Nights. As the rest of these nice folks have said, the law has bigger fish to fry.

Well, on campus we had quite a few people get in trouble for it. They had to wipe out their computers and were monitored but I'm not sure why we haven't seen anyone go to jail yet.

It's a minor offense, the US already has a problem with jail overcrowding, and frankly, it would be a waste of tax payer's dollars.
