I watched "to catch a predator" on MSNBC last night. They trapped a guy who had very sexually explicit chats with what he thought was a 14 year old boy. The news people caught him. Then the next day they went to trap another one and it ended up being him again, using a different name.he ended up at the boys house naked and was sentenced to 2 years in prison, 6 years supervision. Then i watched the local news about a teenager selling ecstacy pills and she's facing 120 years!?!?

The problem is with mandatory minimum sentencing laws.

People didn't like judges having discretionary sentencing, so they yelled and screamed to make sure the judges must sentence people to mandatory minimum times imposed by the legislature.

And then you get things like this, and those two border patrol guys in Texas, where the judge cannot impose a lesser (reasonable) sentence because of statutory mandatory minimums.

I heard Lisa Nowak (crazy astronaut diaper lady) may be facing a life sentence for attempted kidnapping, and yet Mary Winkler pulls a shotgun out of the closet and blows a hole through her husband's back and watches him bleed to death, but the judge is giving her 3-6 years for murder, and considering lowering that because he's concerned that her kids won't have a mother.

The range of punishment may total 120 years, but she will not actually receive that as her sentence. Her prior record will be taken into consideration and guidelines will be determined by the probation/parole officer as to how much time she should receive. A judge normally follows the recommendation of probation/ parole & the state guidelines for that particular violation.

1 there must be somthing more to the ecstacy pils for the idiot to serve that much time, like a murder er somthing, and 2 the justice system is stupid, due to over crowded populations in prison. trust me there is n justice in this world.
