Congrats on the new baby. If you two are happy and being married is what you want, then go for it. If you are emancipated and so is your boyfriend, or if he is legal age, then there is nothing stopping you. The baby deserves to grow up in a happy family.

There's a couple of things you haven't mentioned that would affect this. It sounds like you're about the same age, in which case he would need parental permission or emancipation also. You are very young to be raising a child and parental support would be helpful, but if you are emancipated, then you will loose out on legal enforcement of help from your parents. You could just get written consent from your parents under a hardship clause and then recieve the benefits of being claimed as a dependent by your parents and still marry your child's father. If you boyfriend is over 18, then he could take legal guardianship of you until you are 18. I actually worked with a guy who did this. He'll recieve unending razzing about 'marrying his daughter', but it may work out in the end.

I don't know how your parents can "sign you off" as being "emancipated" when PA is one of the states that does not have emancipation of minors. In PA, they do have Termination of Parental Rights, though, so perhaps you mean to say that and not Emancipation?
With that said, according to the second website whose link I have provided below, it indicates that WITH parental consent you may marry at the age of 16 but WITHOUT parental consent you have to be at least 18 years old.
If your parents are signing their legal rights to you away, then I would imagine they would gladly give their permission so you can marry at the age of 16.
What was and is going on in your life that would make you want to create a child at such a young age? And what kind of parents do you have? Are they kind and involved in your life or were you always left to fend for yourself?

There is a provision in PA. law that allows for people under 18 to get a license if there are 'special circumsyances'. Be that you have a baby together and are being emancipated, that might be among the special circumstances, but you will have to check with the county office that issues licenses.
If both your parents(his and yours are willing) to sign, then the judge will most likely OK it.

well in ny, you can't do anything till your 18. 17 for sex, but 18 for anything else, you or your bf could get nailed for sagitory rape. 2 no one can enter a contract unless they are 18 emancipated or not. I mean if it is true love thats one thing, and i am not tryng to be a critic, but being together so young, If u 2 waited, you could have done a lot more with your lives, but If this is true love, then hell go nuts, and jut be there for one another, and laugh at the critics. again This is ny law, I don't know about pa, but this is a good guideline for u, look it up online if your concerned through the pa gov't page, thier penal law should be there. gl

In my case I married at 20 and my mother had to sign even if I was emancipated. I don't know if in Pennsylvania the age is less for your parent to sign. When you visit the place to get married and ask for the forms, they could tell that information. Good luck!

If you are legally emancipated -- which needs to be approved by the courts, even with your parent's signature -- then yes.

It seems to me that if you are truly "emancipated" you are considered an adult. You might consider questioning your local county attorney or someone in your marriage licensing office.

you should wait till your 18 then get married but if you cant wait then youy should just get married since you two already have a baby with him.
