What is the legal basis for most of the current lawsuits? Negligence? Product Liability? Breach of Contract?

If you're talking about the mass torts for things like Celebrex and Avandia, it is either negligence and/or product liability, depending on whether there was a reasonable expectation that the company should have known or did know ahead of time it was harmful. If you're talking about all lawsuits, I agree with Coragryph.

That's like asking what crime is committed most.

It's not an answerable question unless you want to go on pure statistics -- and then it matter what jurisdiction you sample, whether it's statewide or by county, whether you include federal suits, etc.

And that still doesn't deal with whether you could individual claims and counts separately, or just go with the largest value claim per lawsuit.
